Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

Any new features or tools which are added to the current Website shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

BOOKING CONFIRMATION

Upon purchase, your booking will be submitted to *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves for processing. You will receive a confirmation email describing the date, time, ticket quantity, and cost of your booking. This email confirmation of your order will be taken as proof of your acceptance of the provisions contained in these Terms and Conditions, the Privacy Policy, and the data recorded by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves on its server shall be treated as legal evidence of the transaction between *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves and the Purchaser. 

Prices

Prices of products, services, delivery and other charges displayed on this website are current at the time of issue but may change at any time and are subject to availability.

CANCELLATION POLICY

EVENT CANCELLATIONS - (PUBLIC CLASSES)

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, as a business in the events industry, the success of our business relies heavily on ticket sales. When you purchase a ticket to a class, that secures your place in the class and prevents someone else from purchasing those tickets. We expect all our events to sell out and as such, have a strict cancellation policy to ensure we aren’t experiencing a loss of income last minute. It is the same as purchasing tickets to a concert or to the cinema, who will not refund you if you fall ill or are no longer able to attend. Please do not call us to explain your situation as we handle cancellations via email only.

Cancellations with more than 14 day’s notice: If you book a date, you can no longer attend, we are able to transfer you to a future class of your choice free of charge. 

Cancellations with more than 7 day’s notice: If you e- mail us more than 7 days in advance, we will grant you a Class Credit to be used at a later date, minus a $15 re- booking fee. Please note we are unable to credit the portion of the ticket price that is allocated as a booking fee.

Less than 7 day’s notice: Unfortunately, it is too short notice for us to respond and we do not do administration on the weekends. Please give them to a friend or family member as you would any other event. 

If someone in your group is ill or unable to attend, you may bring someone in their place. As we have limited seating available, “no call, no shows” will not be refunded.

Please Note: We do not offer refunds for class credit if you forget to use it before it expires. 

Cancellation of session by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves

In the event a public session is cancelled by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, the ticket purchaser will be notified via email or text message no later than 24 hours prior to their session scheduled start time. Ticket purchasers will be offered a reschedule to another upcoming session or credited the value of their purchase for future use.

PRIVATE & CORPORATE EVENTS

We require a 50% deposit to be paid in order to secure the booking. We require a minimum of two weeks notice to cancel or postpone a private event as we order supplies, liaise with venues and roster staff two weeks in advance. We can reschedule your event to another date or hold your full refund of the deposit until you rebook. Final payments are issued two weeks prior to the event date and are therefore non - refundable. 

Please ensure your guests are ready to commence painting at the agreement upon start time. We will grant a 10 minute levy, but if our instructor is required to wait further past this time, we will bill you for a late commencement fee. 

ALLERGEN DISCLAIMER

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves (brand) uses local catering companies and therefore, inclusions in our Grazing Boxes vary for our studio. Our Grazing Boxes include food that contains or may contain: peanuts, tree nuts, milk, eggs, sesame seeds, fish, shellfish, soy, lupin, wheat.

If you have any dietary requirements or allergies, please let us know and contact our studio directly.

Grazing boards cannot be rescheduled or cancelled within the 48-hour window. If cancelling or rescheduling a session within this 48-hour window, the cost of the grazing board will be forfeited. For bookings of 6+ tickets, there will be a $25 non-negotiable fee per ticket to cancel or reschedule at any time. When rescheduling, the customer will need to choose the next most convenient session date that is available, or Social Arts WA can provide a credit towards a future booking (minus the rebooking fee).

Important: we are very strict on ‘no shows’. If a customer does not show up for the class, we’ll still charge the full amount. We are unable to refund, reschedule or provide credit for a missed session.

TERMS & CONDITIONS

In exchange for participation in the activity of any and all activities planned, owned and operated by "*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves”, of 25 Ridgewood Drive, Dawesville, WA, and/or use of the property, facilities and services of *Social Arts WA, *ArtatKarens and *Karen Christine Greaves, I agree for myself and (if applicable) for the members of my family, to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, or the employees, representatives or agents of *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves.

2. I recognize that there are certain inherent risks associated with any *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, whether caused by the fault of myself, my family, *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves or other third parties.

3. I agree to indemnify and defend *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves against all claims, causes of action, damages, judgments, costs or expenses, including lawyer fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves.

4. I understand and agree that *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves will not be liable for any actions that I take or participate in during *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves.  

5. I agree to pay for all damages to the facilities of *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves caused by my or my family's negligent, reckless, or wilful actions. 

6. Any legal or equitable claim that may arise from participation in any *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves activity shall be resolved under the law of Western Australia.

7. I agree to follow all laws of Western Australia including laws regarding the consumption of alcohol.

8. I grant to *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, the right to take photographs of me in connection with *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves events. I authorize *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

You must be 18 years of age or older to consume alcohol. *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves is not liable for alcoholic consumption accidents or legal issues during events.

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves provides art class instruction only. Where applicable, any Food or Drink included in the ticket price will be provided by the venue, and must be redeemed during the specified class time. Venues have no obligation to honour food vouchers or tokens presented outside of specified event times.

Outside food and drinks are not permitted at venues hosting *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves events unless specifically stated. Venues for *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves events are not BYO unless specifically stated. 

Public Classes must have a minimum of 10 registered painters 48 hours prior to the event start time in order to be held. Painters who are 13 to 17 years of age must be accompanied by their parent/guardian in order to attend Public Classes.

MINORS 

This Website is not intended for individuals under the age of 18. All participants in *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves public events must be 18 and over. 

School Holiday, Family Friendly events and private functions are suitable for participants under the age of 18. Any all-age events will be advertised accordingly. Staff running children’s events are required to hold a valid Working With Children’s Check or state equivalent.

COPYRIGHT

All artwork, paintings, photos, graphics, text, audio clips, button icons, slogans, trade names and other intellectual property contained on our website, belongs exclusively to *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves. You may not use, reproduce, modify, copy, transmit, display, publish, sell, license, distribute or commercially exploit any of the content or otherwise dispose of any of the content in a way not permitted by us, without our express written consent.

CONDITIONS OF ENTRY TO STUDIO

COVID-19

During the COVID-19 pandemic, *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves are taking all necessary precautions outlined by the state government. *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves reserve the right to refuse entry or ask guests to leave the premises if they do not reasonably follow the below. We ask that guests assist in this by:

·       Practice social distancing of 1.5m between others

·       Washing and sanitising hands

·       Staying home if unwell or showing signs of the virus

·       Staying home if tested positive or are awaiting test results

Respect other guests and staff

Follow guidance of staff and refrain from speaking over painting instructions, hindering the experience for other guests. Customers must respect the staff and may be refused entry or asked to leave the premises if they do not follow such terms.

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves does not tolerate any offensive, inappropriate, obscene, threatening or unruly behaviour towards our staff or guests.

Personal belongings

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves does not accept responsibility for any losses or damage incurred to personal belongings or clothing. Guests should dress appropriately to the activity.

Respect property of *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves.

Guests should not cause damage to any property owned by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves.

Alcohol

A liquor licence is not required to operate a BYO venue (Liquor Act 2007), however *Social Arts WA, *ArtatKarens and *Karen Christine Greaves take precautions to operate responsibly in our studios. It is illegal for a person to supply liquor and for a minor to drink liquor in a BYO venue. *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves prohibit underage drinking.

Smoking

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves premises are strictly smoke-free and smoking is not permitted under any circumstances.

Safety & Security

For the safety and security of guests and staff, please note recorded video surveillance and silent alarms may be in use.

Photography

*Social Arts WA, *ArtatKarens, and *Karen Christine Greaves may take promotional photos or videos during a public or private event. Customers have the right to decline to have their images captured and should make this known to the staff members. Customers should also avoid taking photographs and videos of other guests, unless permission is given. No images are to be captured of minors, unless permission is granted by the parent or guardian.

DISCLAIMER AND LIMITATION OF LIABILITY

The purchaser agrees that the provision of any service, including but not limited to public painting sessions, purchased from our website is at the Purchaser’s sole risk. To the full extent permissible by applicable law, *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves will not be liable for any damages of any kind arising from the use of this site, or from any services provided from this website or establishment, including but not limited to direct, indirect, incidental, punitive, and consequential damages. No oral advice or written information given by *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves nor its affiliates, nor any of their officers’ directors, employees, agents, providers, or the like, shall create a warranty or legal obligation; nor shall the purchaser rely on any such information or advice.

PRIVACY POLICY

Customer information will not be sold, exchanged, transferred, or given to any third party without the consent of the customer other than for the express purpose of delivering the purchased product or service requested by the customer.

If you are placing an reservation, you will be required to provide personal information necessary for order processing. This information will be used for order processing ONLY. The email address you provide, for order processing, will only be used to send you information and updates pertaining to your booking.

If you choose to sign up for our newsletter, you agree to be contacted with special offers, events, and news about *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves that we feel may interest you. If you wish to stop receiving our newsletter, you may unsubscribe at any time by contacting us. Our newsletter email list will ONLY be used for the *Social Arts WA, *ArtatKarens, and *Karen Christine Greaves newsletter and will not be shared with third parties.
